Tabung Amanah Pekerja (TAP) took legal action against Top Star Automobile Sdn Bhd for failing to pay mandatory contributions for their employees within the period specified under Section 23 of the Employee Trust Act (Chapter 167) and Section 26 of the Supplemental Contributory Pension Trust Act (Chapter 276).
The company, represented by its Director, pleaded guilty to the charge of violating regulations requiring employers to contribute to the TAP scheme and SCP scheme for its employees within the required period. In this regard, the Magistrate’s Court in Bandar Seri Begawan has imposed a fine of $1,600.00 and ordered full payment of the fine along with all outstanding TAP and SCP contributions, including accrued dividends amounting to $976.02.
Under Section 26 of the Employee Trust Act (Chapter 167) and Section 29 of the Supplemental Contributory Pension Trust Act, 2009, if found guilty, an employer can be fined not exceeding $3,000.00 for the first offense and not exceeding $10,000.00 for the second or subsequent offenses.
In this regard, to ensure the well-being of TAP members is always protected, employers are reminded to pay their Employee contribution payments by the 15th of the following month to avoid late payment penalties, including dividend loss and service charges.
